If a commercial property has been sold within the last two years there is still time to make a claim. Additionally, Claiming on purchases after April 2014 can be more complex, but still possible. If you are buying or selling a property get in touch as soon as possible to discuss potential claim options. Even if you bought the property in the 80's or 90's you may still be able to claim tax relief today.
UK tax legislation allows tax relief to be claimed on a proportion of the purchase price that relates to the ‘fixtures’ acquired. Most Commercial Property Owners are entitled to claim Capital Allowances on part of the price paid to buy the property. For some premises this can be up to 40% Eligible items may consist of underground pipework, hot and cold water systems, air conditioning, electrical and lighting systems, kitchens, bathrooms, infrastructure and building extensions.
The annual investment allowance (AIA) provides 100% tax relief on assets qualifying as plant and machinery, subject to an annual maximum and excluding cars.
The claims process is designed to have minimum disruption to you and your business. An initial telephone conversation is to collect information and carry out due diligence. Once your case has been reviewed a Capital Allowances survey / walk round will be carried out. The technical team assess, value and prepare a report. Once agreed by all parties your case will be submitted to HMRC. Your claim will be agreed within 4 to 6 weeks. Our chosen partners have a 100% success rate with HMRC.
Embedded Capital Allowance claims require expert knowledge on both property surveying and specialists tax legislation.
Most accounting firms do not have the experience or resources to prepare claims that are up to the standard required by HMRC. Our tax specialists will involve your accountant ensuring your claim is processed compliantly and efficiently.
A claim on property fixtures could represent a considerable tax saving and, in the majority of instances, cash repayments of tax from HMRC. We find on average that between 15 percent and 40 percent of the cost to buy or build the property will qualify for capital allowances.
Yes - We work on a “ ... no win ... no fee ” policy.
Our fee is based on a small percentage of the allowances we find.
There are various different types of claims with differing criteria, for example:
If the answer to the 3 questions below is YES ...
Purchased the Property before April 6th 2014?
Paid UK tax in the last 2 years?
Purchase price £150,000 upwards
... then it's absolutely worth a call to us, without delay!
For properties bought or built before April 2014, there are no time restrictions on eligible claims.
However, from April 2014 new rules were introduced that effectively impose a tax year time limit where allowances have previously been claimed. Claims are still possible for purchases post April 2014. These rules have been tightened and if your property falls into this category we suggest you seek advice from our tax specialists.
Survey / walk round costs are included within our fees. There are no additional costs for a property survey / walk round, regardless of the size or number of properties.
The Survey / walk round Review Form is a short online questionnaire that only takes a few minutes to complete. One of our team will liaise with you and in some instances visit your premises.
Your report will be reviewed to ensure it is complete and accurate in order to arrange the submission to HMRC.
We submit the report to HMRC for you or assist you alongside your Accountant.
The report is submitted on your tax return to allow HMRC to review and approve it before you receive the benefit.
If you need assistance with this step, one of The Business Savings Club Customer Services Managers will help you.
Our clients typically should receive the refund or relief within 28 days from submission to HMRC.
No – these allowances are not taken into account when a property is valued.
However, if the allowances have been identified and valued, it may help you negotiate higher price in a future sale.
We suggest getting in contact ASAP – unless appropriate caveats are included in the contracts before they are exchanged then valuable tax relief may be lost.
There is no time limit to make a claim if you still own the property or sold it in the last two years. If you purchased your property for more than £150,000, and pay tax in the UK, you may be entitled to a tax rebate from HMRC.
Claims take between 6 to 10 weeks.
