UK tax legislation allows tax relief to be claimed on a proportion of the purchase price that relates to the ‘fixtures’ acquired. Most Commercial Property Owners are entitled to claim Capital Allowances on part of the price paid to buy the property. For some premises this can be up to 40% Eligible items may consist of underground pipework, hot and cold water systems, air conditioning, electrical and lighting systems, kitchens, bathrooms, infrastructure and building extensions.
The annual investment allowance (AIA) provides 100% tax relief on assets qualifying as plant and machinery, subject to an annual maximum and excluding cars.
The claims process is designed to have minimum disruption to you and your business. An initial telephone conversation is to collect information and carry out due diligence. Once your case has been reviewed a Capital Allowances survey / walk round will be carried out. The technical team assess, value and prepare a report. For properties bought or built before April 2014, there are no time restrictions on eligible claims.
However, from April 2014 new rules were introduced that effectively impose a tax year time limit where allowances have previously been claimed. Claims are still possible for purchases post April 2014. These rules have been tightened and if your property falls into this category we suggest you seek advice from our tax specialists.

The Survey / walk round Review Form is a short online questionnaire that only takes a few minutes to complete. One of our team will liaise with you and in some instances visit your premises.
Your report will be reviewed to ensure it is complete and accurate in order to arrange the submission to HMRC.
We submit the report to HMRC for you or assist you alongside your Accountant.
The report is submitted on your tax return to allow HMRC to review and approve it before you receive the benefit.

No – these allowances are not taken into account when a property is valued.
However, if the allowances have been identified and valued, it may help you negotiate higher price in a future sale.
We suggest getting in contact ASAP – unless appropriate caveats are included in the contracts before they are exchanged then valuable tax relief may be lost.
There is no time limit to make a claim if you still own the property or sold it in the last two years. If you purchased your property for more than £150,000, and pay tax in the UK, you may be entitled to a tax rebate from HMRC.
